Whether you're new to the tenant scene or you've been renting for the last 20 years, every tenant has rights. Here are the top 5 universal tenant rights throughout the US.

1. Right to a safe living space

You are legally entitled to live in a space that supports your ability to thrive healthfully and safely. If any utility or basic function of your apartment is not functioning properly—the heat doesn’t work; the toilet overflows constantly—your landlord needs to take action to correct it. While your landlord is not necessarily obligated to provide a high-tech security system, locks, deadbolts, and some sort of locking system for windows should be provided for all residences. Gates and keyed access for residents are other ways to protect your security. Your lease agreement will outline the details of security features your landlord is prepared to provide. If you have concerns, document them and get the police involved—you should not be required to stay in or pay rent on an apartment that is not safe.

2. Right to privacy

You have the right to enjoy privacy in your rented living space. Though your home is owned by your landlord, the rent you pay entitles you to a certain degree of privacy. You should receive prior notice when maintenance is going to enter your apartment; if this is not possible, at the very least a note should be left indicating that your apartment has been entered. If maintenance does need to enter your home, it should be locked when they leave to protect your belongings. Should you have a complaint about apartment employees or other tenants violating your right to privacy, bring it up with the landlord.

3. Right to reasonable comfort and quiet

Although your neighbors have the right to enjoy their space, they need to be respectful of you and other tenants as well. If you have noise issues with the apartment above you or can’t bear your neighbor’s habit of piling up trash bags outside his door, you have the right to complain about the behavior and expect that it be addressed. Likewise, other tenants have the right to complain about your habits, so be respectful if you want to be respected.

4. Right to repairs

Unless it can be proven that you created the damage, your landlord is responsible for conducting plumbing, electrical, heating, air conditioning, and other repairs necessary to make your apartment livable. However, landlords aren’t clairvoyant, so it’s your responsibility to report the need for repairs and allow them to be made. Should you not receive a response from your landlord within a reasonable amount of time following a repair request or two, make sure you can document your requests in case you should want to take legal action or move out because the lack of repairs made your apartment unlivable.

5. Right to review a lease agreement

Never, never, ever sign something you haven’t read or don’t understand. It may be tempting to assume that a lease agreement is a “standard” lease agreement that will resemble previous contracts you’ve signed. Each lease is a new agreement between you and your landlord. Read it thoroughly, take it seriously, and ask questions or get legal assistance if you don’t understand what part of the contract means. Even if you later claim that you didn’t realize what you were agreeing to, your claim won’t hold up in court.

Along with rights come responsibilities, of course, and you need to be aware of those as well. Your rights are predicated upon fulfillment of your renters’ responsibilities—most notably paying rent on time and refraining from damaging your apartment—so make sure to hold up your end of the bargain if you want to reap the benefits of renting.

North Hollywood is currently going thru many changes by business owners and developers, hoping to solidify a strong and safe community. One property stands out, The Lofts at Noho Commons. It is a beautiful property, centrally located in the Noho Arts District, across the street from the Metro Station on Lankershim Boulevard. Even through the architecture sets a tone more of a resort than that of a family based residence. There is a hidden story developing here. Under the facade of the modern design and amenities, there is a story of dangers developing. Due to numerous requests by the residents for security directly to the owner(s) at Redwood Partners, Inc. and the management company Legacy Partners, assaults, theft and vandalism run rampant with no resolve. The general consensus is focused on the well being of the children and families that reside here, as well as to deter the inevitability of more violence, further property loss and death.

The North Hollywood Community Police Station regularly sends officers on calls here, most recently regarding a masked male with a crowbar, running within the building’s interior on two of the floors. This was less than 24 hours after four high-end vehicles were vandalized and rims were stolen. Women are afraid to leave their homes with the fears of a possible rape or home invasion. Stairwells are not secured with locks that work properly, or are forced open. Elevators don’t function for weeks at a time. Lights go off for days at a time that cover one half or another of the whole complex. Parts of the complex are over run by trash and filth, which must be violations of health and fire regulations. The sight and smell of urine and feces are found throughout the common areas. Drug dealers and prostitutes live and “work” here, and in the stairwells. And yet nothing happens. This is a very upscale community, which many of its residents demand discretion from their high-visibility and high profile professional lives. All of which have voiced and demanded action with no resolve.

now we have no cold water in our apartment. my upstairs neighbor doesn't have any, either. it trickles out the faucet when you crank the knobs all the way open. it's nearly impossible to shower because the water is scalding. this started when the landlord shut the water off to "fix" our leaky faucet. he does not answer my phone calls, nor does he return my upper-neighbor's calls, either. it's been since June 21. today is July 9. he and his wife do not acknowledge me in any way, shape, or form, and barely speak to my husband. we can never get anything fixed -- ever. to make matters worse, this building is for sale and we're convinced he doesn't care enough to come fix things that the tenants are complaining about because he's selling it.

My apartment flooded due to a bad fixture on a toilet. My entire downstairs (there is one room upstairs, 2 bedrooms downstairs) carpet has to be replaced along with any parts of the walls that were damaged.

This is in Los Angeles county.

Right now, my upstairs is completely filled with stuff from downstairs, so it's not really livable there. The carpet is torn up and shortly will have dry wall holes and dust, etc. My furniture and everything else is all over the place and it will take 2-3 weeks for all repairs to be finished.

Three days ago I awoke to discover our ceiling in our bedroom was leaking. We live in a ground floor apartment. The following day I reported the leak to the front office. I was told that the building is 12 years old, that the roof has holes and that the water is leaking through the roof, down through the walls, and into our apartment. The leak from the ceiling is only the begining. The window sill in the same room is also leaking and has run water into the carpet. There are places on the living room wall that have water damage as well.
I was told at the front office that they couldn't fix anything until the rain stopped. It stopped the next day, btw. I was told the repairs could take up to three weeks to complete and that I should move my furniture into another bedroom of the apartment *because of course we have one empty and with enough space for the master bedroom furniture...not so much* I was also told to 'keep an eye on the carpets because that was what *he* was most worried about* The leasing agent I reported it to *as the office manager doesn't work weekends* didn't even offer to come inspect the leak itself.
The whole situation is very frustrating. We have company coming for Christmas. Less then three weeks til they get here. The apartment will be in disorder from furniture in odd places. And the master bedroom is unlivable. It smells like water. The carpets are still damp.
What I want to know is what are my options? Any advice on the best way to resolve this? I've been advised by friends to put rent in escrow and not pay until the repairs are made, or to purchase things to make the place livable *fans/space heaters* and deduct that from the rent. Are these options legally valid?

Check with your local housing authority. You may withold paying rent, but only for specific things. However, If they're actively working to fix the problem, you will probably have to pay. harasses us to no end ,he doesn't make repairs in our apt. windows need repairs, carpent need replaced we have lived there over 10 years I have asked him to replace the windows for the past years and all he does os laugh...he's very rude... when we moved in heat and hot water was included for the past 3 years he has charged us $90.00 dollars for for the winter months ..he gets an electric bill in his name foe our apt. and the other tenants apts.but he only charges us I want to know can he legaly do this only to us and no one else in the apt. he is also renting 2 storgage rooms to 2 other tenants as a effic. apt.when the code officers come around he has them turned into storgage rooms until they leave if anyone out there has any answers IM AT WITS END OF WHAT TO DO... KNOW I CAN MOVE AND THAT MIGHT BE THE ONLY ANSWER.......

Separate water payments have recently been implemented at my apartment. It is only about $70 (though I was quoted about $40-$50). I pay each month but carry a past due balance. I live in Texas and received a advance notice of lease termination. When I asked the manager I was advised the action is due to non payment of the water bill. I have read a lot about leases and eviction notices. I believe the notice is illegal because they never notified me of their intent to terminate the lease and subsequently I was not offered the opportunity to correct the situation. When I talked to the manager I told her I could pay the balance in full which I have. They have not rescinded the termination of my lease. What can I do?
