Eviction Notice - What To Do

You pay rent on time, keep your apartment reasonably clean, and you think you’re a darn good tenant. You’ve never even considered the possibility of being evicted. Even if you’re sure it’ll never happen to you, it’s important to know the details of the eviction process and the many reasons why you might be evicted. Those who pay rent on time may still be susceptible to eviction due to other factors. Read on to learn more about the various categories of eviction and your rights in each situation.

There are three main types of eviction notices, as well as a separate category of non-eviction notices to vacate. Each type of eviction notice—pay or quit, cure or quit, and unconditional quit—is described below, and the non-eviction notices are covered below.

Pay or Quit Notices (Failure to Pay)

This type of eviction notice may be served if you haven’t paid your rent by the end of the grace period or late period allowed in your lease agreement. The notice will detail the amount of time you have to respond or pay rent (usually five days). Your landlord is required to accept a full rental payment if you offer it, but it is not necessary for your landlord to accept a partial payment from you. However, if he or she does accept a partial payment, this will end the current eviction procedure and another must be started if you fail to pay rent in full. As a tenant, you should know your rent amount and be prepared to pay it on time or deal with the consequences.

Note that completely withholding rent is not usually an acceptable way to deal with your landlord’s failure to fix a problem with your rental unit. Instead of simply neglecting to pay rent, you should disclose the issue to your landlord in writing and take legal action if necessary. You may be able to have a court hold your rent in escrow until your landlord addresses your complaint.

If you don’t pay your rent in full after the amount of time specified in the pay or quit notice, your landlord will probably serve you with an <LINK> unlawful detainer notice. The unlawful detainer is a serious motion which will very likely result in you moving out. To avoid an unlawful detainer or pay or quit notice, pay your rent on time and stay in active communication with your landlord.

Cure or Quit (Violation of Lease Terms)

You can receive this type of eviction notice even if you pay rent. Cure or quit notices inform you of a problem with your tenancy, which may be a violation of lease terms or a result of complaints from other tenants. You might be too noisy or too messy, or perhaps you’re housing a pet that’s not allowed under your lease contract. Regardless of the nature of the problem, your landlord will serve you with a notice—usually a 3-day nuisance notice—and you will have the amount of time specified in that notice to fix the problem.

Review your lease agreement to determine whether your actions are in violation of its terms. If you disagree with your landlord’s assessment of the situation, be prepared to back up your position with text from your lease. It may also be possible for you to work out an agreement with your landlord and neighbors that allows you to slightly modify the terms of your lease—for example, you might be able to add a pet clause to your lease or sign a new pet-accommodating lease if a new pup or kitten is the source of the problem. Still, whether you need to find Fluffy a new home, stop practicing the drums at 3 a.m., or clear the empty beer bottles off your balcony, immediately fixing the problem described in the cure or quit notice is probably the best action to take if you want to stay in your apartment.

Unconditional Quit:

An unconditional quit notice is a harsh measure that provides the tenant with no opportunity to pay rent or make up for actions that have violated the lease agreement. This type of notice might be served if the tenant has failed to pay rent on time for a prolonged period, repeatedly violated terms of the lease agreement, caused extensive damage to the rental property, or engaged in illegal activity (such as selling drugs) on the property. If you’re this type of tenant, you probably already knew this unconditional quit notice was coming to you, and there’s not much you can do about it.

Non-Eviction Move Out Notices:

These notices may be served without cause if your landlord wishes to terminate your rental agreement. Depending on your rental period and the terms of your lease, you may receive either a 7 day no-cause notice (usually for weekly rentals) or a 30 or 60 day no-cause notice (usually for monthly rentals). Just as you can usually give your landlord a specific amount of advance notice if you wish to end a week-to-week or month-to-month lease, your landlord can give you notice to move out if he or she wishes to renovate your living space, get a new tenant, or just stop renting altogether for whatever reason. Since your lease was on a term-to-term basis and your landlord is giving you the required notice, you probably don’t have much recourse in this situation.

The Tenacious Tenant: Fighting back

Counter-Claim:

The grounds for filing a counter-claim against an eviction notice often center on the complaint that the apartment is uninhabitable or that the landlord is otherwise violating your rights as a tenant. Your assertion that this is the case may beg the question as to why you’re still living somewhere so uninhabitable. Still, your landlord is responsible for providing you with a certain degree of comfort in your rental unit, and his or her failure to do so may be legally significant—especially if a health or safety violation if involved.

You may be able to request some form of rent abatement from your landlord or the court in an attempt to mitigate your failure to pay rent in full. Be prepared, however, to provide extensive proof not only of the serious negative conditions but also of your previous efforts to have your landlord correct them. A judge will probably not be impressed with the argument that insufficient parking spaces—which you’d never before complained about—was a justification for your failure to pay rent for three months.

You may also be able to dispute the eviction notice on the grounds that it was improperly served (not directly served to you as the tenant), not worded clearly, or did not provide sufficient time for you to respond. If you are in low-income housing or receive housing assistance, you may have further recourse against an eviction notice. The eviction process is very detailed and landlords must adhere to strict standards when serving an eviction notice. For assistance with disputing eviction procedures or an eviction in general, you should probably consult your lawyer or local legal resources. If you’re planning to defend yourself in an eviction proceeding, this website offers many useful and detailed suggestions about the questions you need to ask and the actions you need to take.

Evading Eviction: The final word

Eviction is a serious proceeding, but it’s one that you can probably avoid or appease by paying rent and being a good tenant. If you’re familiar with the terms of your lease and stick to them, you should be able to avoid getting served with any type of eviction notice. If you research the situation and know your rights, you should be able to avoid getting evicted for issues you can correct.

I have a MA degree and am paid for my experience, however at an entry level rate since I had no prior employment experience. I have been leasing the same apartment since I started my job, no previous serious issues with late rent.

I have not been able to save extra money due to having to pay fees associated with going through a prolonged custody battle with my exhusband (during which time I received no child support) for the past 3 years. I have no family to assist as I was raised by my grandparents who are both deceased. That has never been a problem, my wages were enough to cover expenses for rent and anything else I needed.

As usual, I wrote my check for the month of August and submitted it to my landlord in a timely manner. The next day, as I was checking my online account, I saw some activity that appeared to be fraudulent. I called the bank to address it and they said they would put a "freeze" on the account while the investigation was carried out, meaning that all checks presented would be denied payment. As it happened, my rent check was presented during that "freeze" period.

Not a problem, fortunately the fraud issue was resolved within a few days and my account was accessible again. I was given a letter by my bank to explain to merchants who may have presented checks during that period so that penalties could be waived and everything be ok. I promptly gave my landlord a copy of this letter after having received an nsf notice and assessment of late fees. I received a letter back from the landlord stating that he would waive the late fees but could not waive the NSF fee because it was being charged to him by his bank. If I could pay the balance due within 24 hrs, which was my rent + the $35 nsf fee, I would be current.

Having every intention to satisfy this amount, I went on to work the next day. I ended up getting stranded at work that evening (which was a Friday) when the serpentine belt on my car snapped. My intentions were to go to my bank and pull out the cash to get a money order to pay my rent. Long story short, other parts of the car caused the snap and the car needed to be repaired in addition to the snapped belt. The car was in the shop for the weekend, putting me past the deadline of being able to pay my rental fees. Needless to say the bank was closed by the time I got the car towed and everything, and did not have weekend hours. To make matters worse, it cost $1360 to pay for the car repairs, which was the amount I was saving for rent plus some lent to me by an associate.

I thought, not a problem. I will show this receipt for the car bill to the landlord and see if something cannot be worked out. In the meantime I am served an eviction notice with a summary amount due close to $2000 including rent for aug, sept, and all late fees due by 9/5/08 (with no partial payments accepted).

I am still thinking not a problem. I have a 401K I can request a hardship withdrawal from to cover a situation like this, which would disburse about $1500. in addition I get paid on the 5th my regular check, So I think everything is cool. I call my broker to request the application, faxed. They say it cannot be faxed, must be mailed. I waited patiently for that, and called again to get a fax # to send it back. They say it has to be mailed. I asked how long it takes to process and they say 5-7 business days, and if approved then the time it takes to wait for the check to arrive.

I just received this paperwork yesterday, and plan on mailing it priority back today. However, even if they do it in the minimum of 5 bus days, that will put the processing back to monday sept 8, because this upcoming mon is labor day and not a business day. Waiting for the check to come in the mail will push the actual cash in hand date back to monday sept 15, if it doesn't arrive over that prior weekend. I am planning give a copy of the application to my landlord hoping he can work something out, but right now since everything is going to fall after the 9/5 deadline, it's looking bleak.

this just goes to show that someone who has a job, and has some limited resources who tries their best to compensate for unexpected circumstances can still wind up with the same results as "lazy" or "irresponsible" people.

Both myself and roommates requested a written contract from the landlord and his girlfriend. On July 1st I gave my landlord notice that I would be moving on the 22nd of this month. I told him i figured out my prorated rent for the days I would be staying and it was $42 more than my security deposit. I told him to keep that we'd call it even.

To make a long story short I got a 3 day or quit notice. I don't know if I have any rights since we had continuously been asking for one...

I even offer to stay through this June and will move out by the end of June so he only has to pay me back 4 months worth. He laughed it off, threathened to throw me out and left.
Today, he left noticed that I have 30 days to move and said I am late for this June payment and late charges, he wrote the note as if he never got my payment for those months in advance.
That is the situation, now my questions are:
(1) Am I evicted just like people said no matter what reason and who's right or wrong?
(2) How do I about get to sue this MF so I can get my money back? Will it cost me a lot of money to sue him?
Please help me to solve this situation. I am an adult trying to go back to school. This is a part of my saving being taken away from this guy and I am very hurt.

First, your landlord sends you a eviction due to non-payment of rent.

Time to move, you don't/can't live ANYWHERE for free.

You can stay, and be a freeloader...there is a price to pay.

Or, you can do the right thing, and vacate the premises, since you haven't paid for it. Then most won't ask for a civil judgement.

I am a landlord and worked hard for 20 years to put just enough money away to put a down payment on a multi unit building.

I can't believe the amount of headaches I have from city inspectors, insurance company, the mortgage bank, constant repairs, tenants complaining about other tenants.

Often I am late on my building gas / electrical bill or my mortgage payment and my tenants are paying late or don't want to pay at all for what ever reason.

Overall, I ended last year with negative 8,000. I did not pay myself a single dime and had to use money from my regular job to keep up with payments on this building. So much for starting a business and spending hundreds of hours running after the bank, city inspectors, repair men / contractors and non-paying tenants.

So do me a favor you whining tenants, pay your rent on time and save landlords like me some grief from this unforgiving investment.

I did not working hard socking away money for 15 years so I can let some other people who for what ever reason from bad upbringing or bad luck or partying 'non saving' nature can ride on my buck and live for free for anytime.

I do give rent credits to tenants who help me out taking care of property hallways / mow lawn and property showings / painting / other repairs..

But pigs who have spent their lives messed up, not going to school and partying and are not able to pay their rent and keep up their expenses dont deserve any compassion and need their ass kicked.
