Probably not. He was court ordered to move not court ordered to move and pay. Can't take him to court to pay his share of the rent, it's not that type of contract. You can take him of the lease but can't make him pay. If you qualified for the apartment based on your incomes combined, that may be a problem but either way, you are liable for the rent. The only way he would be liable for the rent is if both of your names are on the lease. Also it must state in the lease that he was going to pay so much a month and you were going to pay this much a month for the rent. Otherwise there is nothing that can be done.
